Record Description :  In accordance with sections 4765.101, 4765.11, 4765.15, 4765.17, 4766.08, and 4766.11 of the Ohio Revised Code (ORC), the State Board of Emergency Medical, Fire, and Transportation Services (via the Division of EMS) may investigate and take disciplinary action against a certificate-holder, license-holder, permit-holder, charter-holder, EMS certificate of accreditation-holder, or EMS certificate of approval-holder who violates any section of ORC or Ohio Administrative Code pertaining to their certificate, license, permit, charter, certificate of accreditation, or certificate of approval. The case file will include all documents gathered as a part of the investigation into alleged violations including: findings, information regarding hearings, recommended disciplinary actions and appeals; dispositions; adjudications; and consent agreements. Limited information regarding case (such as name, case number, final action) is maintained in electronic databases.

Active case files are maintained at the Division of EMS until closed. Closed cases are retained for six (6) years from the date closed and then destroyed. Records pertaining to complaints received about medical transportation organizations that are not elevated to a case investigation are retained based on date of receipt in batches by calendar year and destroyed three (3) years following the date of the end of the calendar year. For six (6) years following a case being closed, investigation information may be needed for use in future cases involving the individual or organization (i.e. subject applies for reinstatement of a revoked certificate or renewal). Records pertaining to complaints received about medical transportation organizations that are not elevated to a case investigation may be accessed for three (3) years following the date of receipt.
