Record Description : Any person who is driving a motor vehicle while under the influence of alcohol and/or controlled substance (D.U.I.) and is arrested by a police officer, will be requested, under Section 4511.191 of the Ohio Revised Code to submit to a chemical test to determine the alcohol and/or drug content in his/her system. If a person refuses, a form "Notification of Refusal to Submit to a Chemical Test" is completed and forwarded from the Police Department to the Bureau of Motor Vehicles, Driver license Special Case Division, ALS/Implied Unit for the purpose of suspending the persons driving privileges. Subsequently, a case is generated. The case contains the Notification of Refusal to Submit to a Chemical Test, notice of suspension, receipt of certified mail or registered mail, notice of appeal, court journal entry, certification of record and a copy of correspondence to the offender. The case is microfilmed by the case number. All driver licenses and temporary permits are forwarded from either the police stations or courts to the Bureau of Motor Vehicles. The licenses are retained in the Safety Responsibility Division, Records/License Consolidation Section until termination of the persons suspension.
