Record Description :  This series consists of copies of files from Industrial Commission from 1981. The files include but are not limited to the following: various United States Department of Labor Office of Workers’ compensation program forms/documents/orders, claimant employment information, various United States Department of Labor Office of Administrative Law Judges, prehearing/hearing orders, documents, claimant medical records, claimant earnings records, retirement/pension records, claimant employment records, employer policies/records, accident reports, human resources records, administrative and court legal documents/filings, attorney fees and cost records, administrative rules, correspondence, compensation and medical payment history, return receipts, calculations for claim reserves. and statistical information.

For Black Lung files: Retain file for 10 years after death of last beneficiary, then destroy; retain denied claim files indefinitely. For Marine Fund (Longshore) files: Retain lost time disability cases for 20 years after case is closed, then destroy; no lost time cases retained for 5 years after case is closed, then destroy; retain cases where last possible beneficiary has died for 6 years and 3 months after the death of such beneficiary, then destroy. Legal Citations: Sections 4131.01 through 4131.06 of the Ohio Revised Code; Title IV of the “Federal Coal Mine Health and Safety Act of 1969,” 83 Stat. 742, 30 U.S.C. 801, as now or hereafter amended; 20 C.F.R. Subchapter B, parts 718, 722, 725, 726; Sections 4131.11 through 4131.16 of the Ohio Revised Code; “Longshoremen’s and Harbor Workers’ Compensation Act Amendments of 1972,” 86 Stat. 1251, 33 U.S.C. 901; 20 C.F.R. Subchapter A, parts 701, 702, 703, 704 Files must be retained to comply with federal law and Department of Labor, Office of Workers’ Compensation program recordkeeping, reporting and audit requirements.
