Record Description : The Managed Care Organizations (MCO) Audits are files that consist of spreadsheets, e-mails, financial documents, medical documents, vocational documents, notes, reconciliation documents, final closing settlement documents, draft audit reports, MCO appeals (concerning the lack of controls discovered during the audits), and the final MCO audit reports. Statute of limitations applies to these date ranges as follows: Contract termination date prior to 09-28-2005 therefore statute of limitations date is 16 years from date of expiration or termination. Contract termination date 09-28-2005 to 09-28-2012 therefore statute of limitations date is 09-28-2021(Section 4 shortens existing date). Contract termination date after 9-28-2012 to 6-15-2021 therefore statute of limitations date is nine years from date of expiration or termination (O.R.C.2305.06). Contract termination date after 9-16-2021 therefore statute of limitations date is six years from date of expiration or termination (O.R.C.2305.06). Retention justification for paper and machine readable media O.R.C. 2305.06 contract in writing. Except as provided in sections 126.301 and 1302.98 of the R.C., an action upon a specialty or an agreement, contract, or promise in writing shall be brought within six years after the cause of action accrued. Section 4; For causes of action that are governed by section 2305.06 R.C. and accrued prior to the effective date of this act, the period of limitations shall be six years from the effective date of this act or the expiration of the period of limitations in effect prior to the effective date of this act, whichever occurs first.
