Record Description :  This retention schedule pertains to records received by the Division regarding a complaint against a registration, license or certification relating to appraisers, appraisal management companies, real estate licensees or foreign real estate licensees or a person engaged in unlicensed activity (ORC 4768.14 or 4735.502) which the Division took action but some of the records are not a matter of public record. This retention schedule consists of, but is not limited to, any correspondence or records received during the Division''s investigation such as documents, exhibits, tapes, CD''s or photographs or any investigative reports or legal memorandums. These records may also contain an appraiser''s current residence which is not a matter of public record for purposes of section 149.03 and 4763.05(A)(1)(a) of the Revised Code. These records are confidential pursuant to Ohio Revised Code Section 4735.05(D) and 4763.03(D) and may contain attorney client communications.

Paper records are retained on-site until the disciplinary file is closed at the administrative level (the date of the Board or Commission Order or upon the expiration of appeals, whichever is later). Then paper records may be maintained in off-site storage for five years after the disciplinary file is closed at the administrative level (date of the Board or Commission Order or upon the expiration of appeals, whichever is later).
