The bankruptcy files are scanned into Universal Document Service (UDS). Retain the electronic version of the bankruptcy files in UDS for 30 years after the bankruptcy case closes. The electronic version information will be reviewed every 3 years to ensure that the files can still be accessed. | The bankruptcy files are BWC’s record of the proceedings of the bankruptcy case. File information is needed in BWC’s collection efforts of outstanding debts within the realm of the bankruptcy. There is no general statute of limitations on re-opening a bankruptcy case. Bankruptcy Code section 362 is the automatic stay provision. It provides a very broad prohibition against all creditors from taking action to collect indebtedness. | Electronic | Delete |
