Record Description :  Litigation case files consist of documents and other information regarding proceedings and other matters before state and federal administrative agencies and state and federal courts including, but not limited to; motions, briefs, comments, objections, legal memoranda, expert analysis (spreadsheets and reports), testimony and exhibits, external communications, formal and informal discovery questions and responses, trial preparation materials and privileged communications. Litigation case files also include documents that have been redacted to protect information that is claimed (generally by third parties) to be proprietary or trade secret and is subject to a protective order or agreement.

Transfer to and maintain in the OCC Electronic Reference Library (ERL); then transfer to and maintain in any system that replaces the ERL. Maintain permanently in a machine readable form. OCC’s electronic data is also backed up. Retain in the OCC Electronic Reference Library. If system is replaced, then transfer to new system. The information contained in case files supports the litigation and/or the settlement positions of the OCC. Paper documents contained in case files are scanned into the ERL. After the Paper document is scanned, it can be disposed of once it is no longer of administrative value. It is only neccessary to maintain the paper copy until it is no longer of administrative value since the paper copy is scanned and stored in the ERL. Paper Recycle
