149.43 Availability of public records for inspection and copying.
“Public record” does not mean any of the following:
(a) Medical records
(g) Trial preparation records;
(h) Confidential law enforcement investigatory records;
As a result of amendments to Ohio Revised Code 4123.88 contained in Senate Bill 7, the records contained in the claim files maintained by BWC are not public records.

Record Description : These files contain attorney work product in representing the Special Investigation Units, before the Medical Payment Dispute Committee. The MPDC is a panel of 3 members; BWC Medical Policy and Support Services, BWC Medical Billing and Adjustments, and BWC Legal Division. Contains; A copy of Special Investigation Units /Report of Investigation, may contain Fraud Management System (FMS) notes, spreadsheets of the provider overpayment, medical reviews, possibly video or audio tape, copies of claim file information, correspondence with opposing counsel i.e. discovery request with the Bureau’s response, a copy of the Committee Order and possibly a copy of The Administrator’s Designee’s Order if appealed to second level.
