Record Description :  These files document Division investigations. They contain correspondence, with accompanying mail or delivery receipts; names and addresses of involved parties; confidential law investigatory records; trial preparatory records; attorney work product; testimony; transcripts; financial records; the records of administrative, civil and criminal actions; notice and final orders; depositions; and case disposition records. These files also include investigatory examination reports containing information regarding the records and affairs of entities as obtained and assembled by division personnel. Materials include division report forms, examiner worksheets, entity financial records, and other documentation obtained from the entity necessary to determine if any violation of O.R.C. 1707.01-99 has occured.

Retain in appropriate storage area until case is closed. After case has been closed 5 years, or files have been scanned and verified, then destroy. O..C. 1301:6-3-48 reads in pertinent part: "...scheduled retention peroid of which shall be no less than five years from the date the enforcement file containing this documentation is deemed closed by the division." Maintain securities machine readable records on database until information is effectively replaced or the retention series is no longer maintained, then destroy by erasure. Download from electronic transmissin to disk and retain with paper file in appropriate storage area until case is closed. After case has been closed 5 years, destroy by erasure.
